1. Terms of Sale Terms
1.1 These Terms and Conditions apply to the purchaser of the Luminescence Collection Web Store (hereinafter Consumers) and Lumily OÜ (hereinafter Luminescence Collection) for the purchase of goods and services.
1.2 In addition to these terms, purchasing from Luminescence Collection is regulated by the Republic of Estonia, the Law of Obligations Act (hereinafter LOA) and Consumer Protection Act (hereinafter CPA) and other legislation.
1.3 Luminescence Collection reserves the right to make changes to the terms of sale. These changes are reflected on Luminescencecollection.com. Orders submitted prior to the entry into force of the amendments are subject to the conditions applicable at the time of placing the order.
1.4 Payment options are credit cards and direct payments of Estonian bank links offered by Maksekeskus.ee. Payments with Estonian banking links take place outside the secure online payment environment of the e-store, which is being arranged by Maksekeskus AS. Luminescence Collection Web Store does not have access to your bank’s data.
1.5 By purchasing goods at Luminescence Collection, the Consumer confirms that they are familiar and agree to the terms of sale.
1.6 Luminescence Collection is the controller of personal data, we shall transmit your personal data necessary for the execution of payments to the authorized processor to Maksekeskus AS.
2. Price Information
2.1 Luminescence Collection prices for products sold are shown in Euro and include current VAT of 20% in the Republic of Estonia.
2.2 The price of the transport shall be added to the price of the transport in accordance with the mode of delivery chosen by the Consumer.
3. Discount Code Terms
3.1 All discount codes are applied to the value of the order, excluding delivery costs and are subject to our general sale terms.
3.2 The discount code must be entered in to the Coupon Code field on the basket page and then clicked “apply coupon”.
3.3 Discount code will not apply to when purchasing a Gift Card.
3.4 Only one code can be applied to an order.
4. Order completion
4.1 Add the desired items to the cart. After adding to cart, you can continue browsing the products or start ordering. Products in the cart can be added, exchanged or deleted before placing an order and paying for goods.
4.2 In order to deliver goods, the Consumer shall choose the preferred payment and shipping method and enter the questionnaire so that Luminescence Collection can obtain the necessary shipping inrormation and, if necessary, contact the Consumer.
4.3 Orders made in the Web Store will be sent out in 24h.
5. Entry into force of the sales contract
5.1 The sales contract is deemed when 100% of amount shown on order is received Lumily OÜ bank account.
5.2 Luminescence Collection Online Store enters into the Commodity Purchase Agreement to provide the Consumer with the goods acquired in the future, manufactured or purchased by Luminescence Collection, and to enable the transfer of ownership to the Consumer.
However, the consumer undertakes to pay Luminescence Collection the amount shown on the invoice for the goods and accept the goods.
5.3 Orders that have not been paid will be canceled after 3 days from the date of the order.
6. Delivery and receipt of goods
6.1 After the entry into force of the sales contract, the goods reach the consumer not later than within 3 business days when order destination is Estonia. Shipping to Europe takes an average of 6 working days and shipping to the rest of the world takes an average of 10 working days.
6.2 The accuracy and correctness of the data provided in the order depend on delays and misunderstandings in the delivery of the goods.
6.3 Luminescence Collection Web Store does not bear responsibility for delays in delivering products and for misunderstandings if the delay or misunderstanding is due to the inaccuracy of the information given by the Consumer in completing the order.
6.4 Before introduction of the product inspection:
– This product meets your expectations (color, size).
– This product has not been damaged during transport.
7. Right of Return
7.1 The customer has the right to return the goods within 14 days from the receipt of the goods.
7.2 In the event of a deterioration in the condition of the item to be returned, the Consumer shall be liable for the loss of value resulting from the use of the item only if he has used the item in any other way than is necessary to satisfy the nature, characteristics and operation of the thing.
In order to confirm order substance, characteristics and functioning of the item, the Consumer should treat and use the goods only as if it would normally be allowed to do it in the shop.
The product to be returned or exchanged must not contain any signs of use (dirty, fragrance, damaged).
Returned goods must be labeled and original.
If the returned goods or sales package has been violated, the goods have been removed, then the product will not be returned or converted.
Luminescencecollection.com is not required to take back products that have deteriorated. Transportation costs for degraded goods are borne by the Consumer.
7.3 In order to return the goods, a wish to withdraw from the purchase of goods must be submitted and sent to the e-mail address
email@example.com not later than within 14 days upon receipt of the goods.
7.4 The consumer must return the goods within 14 days following the submission of the application or provide proof that he has delivered the goods to the logistics company.
7.5 Items must be returned at the customer’s expense and you must post via recorded delivery in case your order is lost.
7.6 Luminescence Collection Web Store shall, upon receipt of the Goods, immediately, but not later than 14 days after receipt, to the Consumer, all charges received from the Customer under the Contract.
8. Force Majeure
8.1 Luminescence Collection Web Store does not bear responsibility for any loss or delivery of goods if the goods are delivered to the logistics partners at the right time, but the delivery is due to circumstances that the Luminescence Collection store could not influence or anticipate.
9. Processing of personal data
9.1 The consumer enters the data in the web store and with the corresponding confirmation the right to collect and process the Consumer’s personal data (name, contact phone number, delivery of the package and / or home address, e-mail address) and provide personal data to the logistics partner for the delivery of the goods.
9.2 Luminescence Collection has the right to use the Consumer’s residence or address to provide the Consumer with the advertisement and other information.
9.3 The consumer has the right at any time to prohibit the collection and use of his personal data, unless this is necessary to recover a claim arising out of a contract or to deliver the goods.
9.4 Luminescence Collection Web Store does not have access to your bank’s data.
10. Claims procedure
10.1 Luminescence Collection is responsible for non-compliance or defects in goods sold to the Consumer for the term of up to two years from the delivery of the goods to the Consumer.
10.2 The consumer has the right to contact the Luminescence Collection at the latest within two months upon occurrence of the defect, giving an invoice for the purchase of the goods.
10.3 In the event of a defective product, we ask that you stop using the goods.
10.4 Luminescence Collection and the Consumer agree to repair or replace the defective goods. Improvement costs are covered by Luminescence Collection.
10.5 Luminescence Collection is not liable for defective products caused by the Consumer due to improper storage or non-end use of the product.
10.6 Luminescence Collection will not be liable for any damage caused by a transport company due to a fault on the part of the transport company.
10.7 In the event of non-compliance or deficiencies in the product, please contact firstname.lastname@example.org with a claim stating the name of the ordering party, the contact phone number, the order number and the exact description of the non-compliance or defect in the product.
10.8. Claims for non-compliance or deficiencies in the product must be submitted within two months from the discovery of the non-conformity or defect of the product.
10.9. All complaints will be reviewed and contacted by the Consumer as soon as possible, but not later than within 14 days from receipt of the complaint.
10.10 The consumer is entitled to require Luminescence Collection to lower the purchase price or terminate the contract and repay money for the goods if the Luminescencecollection.com web site can not be repaired or replaced, the repair or replacement of the goods fails, Luminescence Collection does not have a shortage of goods within a reasonable time has eliminated unreasonable inconvenience to the consumer.
11. Consumer right to appeal to the Consumer Complaints Board
11.1 If the Web Store has refused to resolve the Consumer’s complaint or the Consumer does not agree with the solution offered by the Web Store and finds that his rights have been violated or his benefit has been violated, the Consumer may submit a complaint to the Consumer Complaints Commission through the Consumer Protection Board or the court. The consumer may lodge a complaint through himself or through a representative.
